Waiver and Release of Liability

In agreeing to participate in Crossfit, I, [customer.name], agree as follows:

In agreeing to participate in the gym at Crossfit South West 6230 and its activities hosted outside the gym, I, [customer.name], agree as follows:
I fully understand and acknowledge that Crossfit has (a) inherent risks, dangers, and hazards and such exists in my participation in this activity; (b) my participation in such activity may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability; (c) by my participation in these activities, I knowingly and freely assume all such risks and dangers (both known and unknown) and all responsibility for any losses and/or damages.

I, on behalf of myself, my personal representatives, assigns and my heirs, and in the case of family membership, to any minor on whose behalf you sign as parent/guardian hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify the Five Mountains Pty Ltd (trading as Crossfit South West 6230) and their respective owners, officers, affiliates, agents and employees, other participants, sponsoring agencies, sponsors, advertisers and, if applicable, owners and lessors of premises used to conduct any sponsored event (Releasees), from any and all claims, actions or losses with respect to any and all injury, disability, death, or loss or damage to person or property whether arising from the negligence of the releasees or otherwise, that may arise out of or in connection with your use of the equipment or the facilities of the gym or any incident that occurs while using the gym facilities or engaging in gym activities on or off the premises of otherwise related to your membership and all its members from any and all claims. I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future.

I understand that I am responsible for informing my instructors of any pre-existing medical conditions or injuries that may affect my ability to participate in training. I understand that if during the course of my training I develop any medical conditions or injuries that I will inform my instructor about them.

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE. IT IS MY INTENTION TO EXEMPT AND RELIEVE FIVE MOUNTAINS PTY LTD AND ITS MEMBERS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH BY ANY CAUSE.

Photo Permission

I give Crossfit South West 6230 permission to take my photograph/video footage to be used on any of their social media platforms as well as any marketing material. I understand that Crossfit South West 6230 will not seek further permission to use any photographs/video taken. If you do not wish for your photo/video to be taken it is your responsibility to advise Crossfit South West 6230 of this in writing.

Cancellation Policy

I agree to the above membership and acknowledge 7 days notice is required to cancel my membership or to hold my membership payments. This is required in writing via admin@cfsouthwest.com or www.cfsouthwest.com.
